1. About this policy
FARM GUARD operates this website as a business-to-business enquiry and product information service for agricultural shade net, woven ground cover, frost cloth, mulch film and related commercial supplies. This Privacy Policy explains how we collect, use, disclose, store and protect personal information when you visit the website, request a quotation, contact us or otherwise deal with us.
This policy is designed to explain our practices with reference to the Australian Privacy Act 1988 and the Australian Privacy Principles, and the EU General Data Protection Regulation (GDPR), where those laws apply.
2. Information we collect
Depending on how you interact with us, we may collect:
- Business and contact information: your name, job title, company name, email address, telephone or WhatsApp number, business address and delivery destination.
- Enquiry and quotation information: requested product, dimensions, GSM, shade rate, colour, quantity, packaging, application, destination, required delivery date and other project specifications.
- Communications: messages, attachments, samples requested, quotation history and records of support or commercial discussions.
-
Technical and usage information: IP address, browser and device type, approximate location, referring page, pages viewed, timestamps, cookie identifiers and information about how the website is used.
- Transaction administration: if a quotation later becomes an order, we may retain pro forma invoice, payment status, shipping and customs information. Eligible standard products may also be purchased through the Shopify online checkout. Payment card information is processed by authorised payment providers, including PayPal. FARM GUARD does not receive or store full payment card details. We may retain payment status, pro forma invoice, shipping and customs information where needed to administer an order.
Please do not send sensitive personal information unless it is necessary and we have specifically requested it.
3. How we collect information
We collect information directly from you when you submit the Wholesale Enquiry or Contact form, contact us by email or WhatsApp, request a sample or quotation, or correspond with us. We may also collect technical information automatically through Shopify, cookies and similar technologies. For a commercial project, information may also be provided by your employer, colleague, freight provider, purchasing agent or another party authorised to deal with us.
4. Why we use your information
We use personal information only where reasonably necessary for legitimate business or legal purposes, including to:
- respond to enquiries and prepare quotations, samples, specifications, lead-time estimates and freight options;
- take steps requested before entering a contract and administer an accepted quotation or order;
- communicate about production, quality documents, packing, logistics, delivery and after-sales support;
- operate, secure, troubleshoot and improve the website and prevent fraud, misuse or malicious activity;
- maintain business, tax, customs, compliance and dispute records where required;
- send product updates, technical guides or wholesale pricing where you have requested them or where otherwise permitted by law. You can unsubscribe at any time.
Where the GDPR applies, our lawful bases may include steps taken at your request before a contract, performance of a contract, compliance with a legal obligation, our legitimate interests in operating and protecting a B2B supply business, and consent where consent is required. You may withdraw consent at any time without affecting processing already carried out lawfully.
5. Cookies and similar technologies
Shopify and service providers may use cookies, pixels, local storage and similar technologies to keep the website functioning, remember preferences, measure performance, protect the service and understand website use. Some cookies are essential. Analytics or marketing cookies, if enabled, are used subject to applicable consent requirements. You can use available cookie controls or your browser settings to block or delete cookies, although parts of the website may not work correctly.
6. When we share information
We do not sell personal information. We may disclose only the information reasonably necessary to:
- Shopify, which hosts the store, and providers of website, email, cloud storage, security, analytics and communications services;
- factories, packaging providers, sample couriers, freight forwarders, carriers, customs brokers, warehouses and other parties involved in preparing or delivering a requested quotation or order;
- professional advisers, insurers, auditors or authorities where reasonably necessary to protect rights, comply with law or respond to valid legal process;
- a successor or prospective buyer in connection with a genuine business reorganisation, subject to appropriate confidentiality safeguards.
Service providers are expected to use information only for the relevant service and to protect it appropriately. Shopify processes information under its own privacy terms; further information is available in the Shopify Consumer Privacy Policy.
7. International data transfers
FARM GUARD operates from China and serves overseas business customers. Information may therefore be processed in China and in other countries where Shopify, email, cloud, logistics or professional service providers operate. Privacy laws in those countries may differ from those in your location. Where required, we use reasonable contractual, organisational or other safeguards for international transfers, including approved transfer mechanisms where applicable.
8. Data retention
We retain personal information only for as long as reasonably needed for the purpose for which it was collected, including quotation follow-up, supplier and customer administration, legal, tax, customs, warranty, dispute and security requirements. When information is no longer required, we take reasonable steps to delete or de-identify it, unless retention is required by law.
9. Security
We use reasonable technical and organisational safeguards appropriate to the nature of the information. However, no internet transmission or storage system is completely secure. Do not send confidential payment credentials or unnecessary sensitive information through an enquiry form or ordinary email.
10. Your privacy rights
Subject to applicable law, you may request access to the personal information we hold about you, ask us to correct inaccurate or incomplete information, or make a privacy complaint.
Where the GDPR applies, you may also have rights to request erasure, restrict processing, object to certain processing, receive portable data, and withdraw consent. You may object to direct marketing at any time.
To make a request, email info@yongkangagri.com and describe what you need. We may request reasonable information to verify your identity and authority. We will respond within the period required by applicable law; where the GDPR applies, this is generally within one month, subject to lawful extensions or exceptions.
11. Complaints
If you believe we have not handled your information appropriately, contact us first at info@yongkangagri.com. We will review the concern and respond within a reasonable time. Where applicable, you may also complain to the Office of the Australian Information Commissioner through oaic.gov.au, or to the data protection authority in your country or region.
12. Children
This is a B2B website and is not directed to children. We do not knowingly collect personal information from children. If you believe a child has provided information to us, please contact us so that we can review and delete it where appropriate.
13. Changes to this policy
We may update this policy to reflect changes to our services, technology or legal obligations. The current version will be posted on this page with the updated date.
